Berrien County Court Records

Berrien County court records are the formal documentation and chronological accounts of legal actions heard and decided within the Berrien County Trial Court system. These records encompass everything from initial filings and evidentiary submissions to final judicial determinations.

In Berrien County, court records custody is shared among the Berrien County Clerk (for circuit court records), the District Court clerks (for district case files), and the Register of Probate (for estate records). Each custodian generates and manages its records under the authority of the Michigan Court Rules (MCR) and the Michigan Trial Court Case Management standards.

Court records provide a comprehensive legal history, making them distinct yet interconnected with other official records, such as arrest records, which document bookings, and vital records, which chronicle local births, deaths, and marriages. Arrest and vital records are often admissible as evidence in criminal or probate court matters, respectively.

Berrien County Court Records Search

Berrien County operates a unified court system and largely centralizes the process for searching court records. However, the specific custodian may vary depending on whether the matter is a criminal or civil case.

The primary method for online access to court information is the statewide MiCOURT case search portal. It provides court summaries for any nonconfidential case. Inquirers should select "Berrien County Trial Court" from the jurisdiction menu, then conduct a search by party name, case number, or attorney bar number.

While case dockets are freely viewable through MiCOURT, the corresponding documents are generally not printable. Nonetheless, this public interface typically displays the case status, a list of filed documents, upcoming hearing dates, and final dispositions (for a closed case). Individuals cannot use this method to inspect confidential information, such as juvenile cases and other sensitive proceedings.

Where documents are not available online, the public may visit the court’s physical locations and use the self-service terminals to perform basic case searches and view electronic case data at no cost. Researchers can also visit the records window of the relevant court clerk’s office for assistance regarding manual searches or record certification.

The public can also obtain court case records via mail, email, or fax requests. For example, regarding Circuit Court records, individuals can complete the Court Records Request Form and provide a full name, date of birth, and range of years to be searched. If requesting by mail, a self-addressed stamped envelope (SASE) and a check or money order should be enclosed. Completed forms should be mailed to the Berrien County Clerk at 811 Port Street, St. Joseph, MI 49085.

Criminal Records Access in Berrien County

Individuals may access Berrien County criminal records through two primary methods: comprehensive background checks through the state repository and individual criminal case checks through the local Trial Court system.

Searchers may obtain comprehensive criminal background history reports by making a request at the Criminal Justice Information Center (CJIC), an arm of the Michigan State Police (MSP). The CJIC is the statutory custodian for all fingerprint and conviction data reported by law enforcement and courts from all 83 Michigan counties. The public may request two types of background checks through this avenue:

  • Name-Based Check: Uses the Internet Criminal History Access Tool (ICHAT) to compile a record of felony and misdemeanor convictions, including pending cases. The service costs $10 per search and requires a user account, though anyone can run a one-time search as a guest.
  • Fingerprint-Based Check: Utilized for immigration, adoption, and other purposes with stringent requirements. The service costs $30 for a standard check and must be conducted through a local law enforcement agency.

Alternatively, searchers can query the statewide MiCOURT search portal by name or case number to view a detailed log of a specific conviction or ongoing criminal case. Inquirers may also contact the County Clerk or District Court Clerk for assistance regarding specific criminal case files, such as a judgment of conviction.
